ORDER

The defendant, Juan Carlos Done, having filed a motion under Federal Rule of Criminal Procedure 32(d) to withdraw his guilty plea (the "Motion"), and the defendant having alleged ineffective assistance of counsel on the part of counsel in his underlying criminal case (Crim. No. 09-601 (JLL)); and the parties having been heard in open Court on August 7, 2012; and the defendant having stated in open Court that he consented to waiver of attorney-client privilege with respect to the issues raised in the Motion;

IT IS THE FINDING OF THIS COURT that the defendant knowingly and voluntarily waived the attorney-client privilege with regard to the issues raised in the Motion.

IT IS THEREFORE ORDERED on this 7th day of August, 2012, that:

1. The Government may interview Bruce S. Rosen, Esq. in the presence of defendant's current counsel, at a mutually convenient time and place, regarding the issues raised in the Motion; and

2. Bruce S. Rosen, Esq. shall give testimony regarding the issues raised in the Motion when the Court orders a
