STATE OF NEW JERSEY, PLAINTIFF-RESPONDENT,
ANGELO BURGOS, DEFENDANT-APPELLANT.
On appeal from Superior Court of New Jersey, Law Division, Bergen County, Indictment No. 97-12-02194.
NOT FOR PUBLICATION WITHOUT THE APPROVAL OF THE APPELLATE DIVISION
Submitted February 14, 2011
Decided Before Judges Rodriguez and Coburn.
Defendant was convicted of murder, six counts of armed robbery, and related offenses. The aggregate term of imprisonment was life plus twenty years, thirty years to be served without parole. We affirmed and the Supreme Court denied certification. State v. Burogs, 172 N.J. 359 (2002).
Defendant then moved for post-conviction relief, which was denied. He appealed, we affirmed, and certification was denied. State v. Burgos, 196 N.J. 598 (2008). Then defendant filed the petition now under consideration.
After carefully considering the record and briefs, we are satisfied that defendant's arguments are without sufficient merit to warrant discussion in a written opinion. R. 2:11- 3(e)(2). Nevertheless, we add the following comment.
The arguments offered here are the same as the arguments we rejected on the direct appeal and the prior post-conviction relief appeal. Consequently, we are obliged to affirm. State v. Preciose, 129 N.J. 451, 476 (1992).
