Jay L. Thomas v. Care Plus Foundation

SUPERIOR COURT OF NEW JERSEY APPELLATE DIVISION

December 20, 2010

JAY L. THOMAS, PLAINTIFF-APPELLANT,
v.
CARE PLUS FOUNDATION, INC., DEFENDANT-RESPONDENT.

On appeal from Superior Court of New Jersey, Law Division, Special Civil Part, Bergen County, Docket No. DC-012949-09.

Per curiam.

NOT FOR PUBLICATION WITHOUT THE APPROVAL OF THE APPELLATE DIVISION

Argued December 7, 2010 -

Before Judges Parrillo and Skillman.

In 2007, defendant, a non-profit corporation that provides financial assistance to needy students, awarded a scholarship of up to $2000 to plaintiff to attend college during the 2007-08 school year. In the fall of 2007, plaintiff allegedly submitted an invoice to defendant seeking reimbursement for money he allegedly expended for books. Defendant declined payment because it denied receipt of the invoice. This denial precipitated three lawsuits by plaintiff seeking reimbursement for the alleged costs of those books, all of which were dismissed by the trial court.

This appeal is from the dismissal of plaintiff's third complaint. We affirm substantially for the reasons set forth in Judge Rosa's January 28, 2010 oral opinion. Plaintiff's arguments do not warrant any additional discussion. R. 2:11- 3(e)(1)(E).

Affirmed.
