Greenblatt v. Darvin

SUPERIOR COURT OF NEW JERSEY APPELLATE DIVISION

May 4, 2009

MARTIN GREENBLATT, PLAINTIFF-APPELLANT,
v.
CRAIG E. DARVIN, DEFENDANT-RESPONDENT.

On appeal from the Superior Court of New Jersey, Law Division, Middlesex County, Docket No. L-2092-08.

Per curiam.

NOT FOR PUBLICATION WITHOUT THE APPROVAL OF THE APPELLATE DIVISION

Argued April 22, 2009

Before Judges Cuff and Fisher.

Plaintiff appeals an order that dismissed his complaint, which alleged the negligence or misconduct of defendant, an attorney who represented plaintiff's adversary in an earlier suit. The record reveals that plaintiff has filed numerous suits concerning related issues in both federal and state court that have been finally adjudicated -- a circumstance that bars further litigation of any other aspects of the same set of facts and transactions regardless of whether the particular claims in question were previously asserted.

Having found plaintiff's arguments to be of insufficient merit to warrant discussion in a written opinion, R. 2:11- 3(e)(1)(E), we affirm the order under review.
