Unity Bank v. Galle

SUPERIOR COURT OF NEW JERSEY APPELLATE DIVISION

December 14, 2007

UNITY BANK F/K/A FIRST COMMMUNITY BANK, PLAINTIFF-RESPONDENT,
v.
ANTHONY GALLE, BARBARA A. GALLE A/K/A BARBARA ANNE GALLE, DEFENDANTS-APPELLANTS.

On appeal from Superior Court of New Jersey, Chancery Division, Hunterdon County, Docket No. F-18481-01.

Per curiam.

NOT FOR PUBLICATION WITHOUT THE APPROVAL OF THE APPELLATE DIVISION

Submitted December 4, 2007

Before Judges Skillman and Winkelstein.

Defendants appeal from an order of the Chancery Division, entered on February 23, 2007, which denied their motion to vacate the final judgment of foreclosure of plaintiff's mortgage upon their real estate located at 172 State Highway 31, Hampton, New Jersey, entered on February 23, 2005. Defendants present the following arguments:

I. THE COURT ERRED IN FAILING TO CONSIDER SUBSTANTIAL AND CREDIBLE EVIDENCE[.]

II. THE APPELLATE DIVISION SHOULD CORRECT THE FINDINGS OF THE CHANCERY COURT[.]

We reject these arguments and affirm the trial court's denial of defendants' motion to vacate the final judgment of foreclosure substantially for the reasons set forth in Judge Derman's February 23, 2007 memorandum decision. Defendants' arguments do not warrant any additional discussion. R. 2:11-3(e)(1)(E).

Affirmed.
