Yadav v. Township of West Windsor

SUPERIOR COURT OF NEW JERSEY APPELLATE DIVISION

October 22, 2007

RAJESHWAR SINGH YADAV AND ROOPA YADAV, PLAINTIFFS-APPELLANTS,
v.
TOWNSHIP OF WEST WINDSOR, DEFENDANT-RESPONDENT.

On appeal from the Superior Court of New Jersey, Law Division, Mercer County, Docket No. L-1066-06.

Per curiam.

NOT FOR PUBLICATION WITHOUT THE APPROVAL OF THE APPELLATE DIVISION

Argued: October 11, 2007

Before Judges Cuff and Lisa.

Plaintiffs Rajeshwar Singh Yadav and Roopa Yadav filed a complaint on April 24, 2006, challenging amendments adopted in 1991 and 1999 to the zoning ordinance of defendant Township of West Windsor that affects property owned by them. Plaintiffs appeal from the July 14, 2006 order granting defendant's motion for summary judgment, the July 27, 2006 order imposing $7600 in fees and costs, and the September 19, 2006 order as corrected by a December 15, 2006 order, denying plaintiffs' motion for reconsideration.

Having considered the entire record, we are satisfied that the arguments presented are without sufficient merit to warrant discussion in a written opinion. We affirm substantially for the reasons expressed by Judge Feinberg in her thorough opinions of July 14, 2006 and September 15, 2006.

Affirmed.
