Tripolsky v. State

SUPERIOR COURT OF NEW JERSEY APPELLATE DIVISION

September 24, 2007

SYLVIA TRIPOLSKY, APPELLANT,
v.
STATE OF NEW JERSEY, DEPARTMENT OF THE TREASURY, DIVISION OF PENSIONS AND BENEFITS, RESPONDENT.

On appeal from a Final Administrative Determination of the Board of Trustees of the Public Employees' Retirement System, PERS #2-10-202458.

Per curiam.

NOT FOR PUBLICATION WITHOUT THE APPROVAL OF THE APPELLATE DIVISION

Submitted September 17, 2007

Before Judges Gilroy and Baxter.

Sylvia Tripolsky appeals from a final administrative determination of the Board of Trustees of the Public Employees' Retirement System (Board) denying her request to reverse an earlier decision of the Division of Pensions and Benefits that reduced her monthly retirement allowance by $15. That reduction was attributable to a recalculation of Tripolsky's retirement date to correct erroneous information transmitted by her former employer, the State of New Jersey.

The Board's final administrative determination thoroughly analyzes the facts, and reaches proper conclusions of law. Tripolsky's arguments to the contrary are without merit and do not warrant discussion in a written opinion. R. 2:11-3(e)(1)(D) & (E). We affirm substantially for the reasons set forth by the Board in its comprehensive opinion of August 17, 2006.

Affirmed.
