Johnson v. Board of Review

SUPERIOR COURT OF NEW JERSEY APPELLATE DIVISION

June 6, 2007

JAMES C. JOHNSON, APPELLANT,
v.
BOARD OF REVIEW, DEPARTMENT OF LABOR AND OHIO CASUALTY GROUP, RESPONDENTS.

On appeal from Department of Labor and Workforce Development, Docket No. 68,679.

Per curiam.

NOT FOR PUBLICATION WITHOUT THE APPROVAL OF THE APPELLATE DIVISION

Submitted May 22, 2007

Before Judges Skillman and Holston, Jr.

Appellant James C. Johnson appeals from a final decision of the Board of Review, which determined that he voluntarily quit his job, and therefore, was disqualified under N.J.S.A. 43:21-5(a) from receiving unemployment compensation benefits as of June 27, 2004, and liable under N.J.S.A. 43:21-16(d) for repayment of the $7667 in benefits erroneously paid to him during the period of disqualification. We affirm substantially for the reasons set forth in the final decision of the Board of Review. See also Bannan v. Bd. of Review, 299 N.J. Super. 671, 674-77 (App. Div. 1997).

Affirmed.
