ORDER

This matter comes before the Court upon joint request by parties in the instant action for amendment of this Court's Opinion dated October 19, 2005, grating Plaintiffs' motion for final approval of settlement; and page 3, section entitled Anti-Tier Bumping Provision of the Court's Opinion reading in particular part:
Anti-Tier Bumping Provision: Defendant has agreed to an anti-tier bumping provision. Specifically, Defendant will monitor and send out notice to all its dealer that they no longer have authority to "bump-up" consumers to more expensive credit tiers that do not adequately reflect their credit status. (citations omitted).
IT IS on this 3rd day of November, 2005;
ORDERED that page 3, section entitled Anti-Tier Bumping Provision of the Court's Opinion is amended to read:
 
Anti-Tier Bumping Provision: Defendant has agreed to prohibit any movement of an applicant from a more creditworthy tier to a less creditworthy tier for any purpose other than Defendant's customary credit criteria in place at that time. (Settlement Agreement ΒΆ 10.5.); and it is ...
