This matter having come before the court, upon the motion for summary judgement by Defendant Underwood Memorial Hospital and the cross-motion for partial summary judgement by Plaintiff Lorraine Hill, the Court having reviewed the submissions of the parties, for the reasons set forth in an Opinion issued by this Court, which findings of facts and conclusions of law are incorporated herein by reference, and for good cause appearing,

IT IS on this 20th day of April, 2005,

ORDERED THAT:
1. Defendant's motion for summary judgment with respect to Plaintiff's federal claims is hereby GRANTED.
Plaintiff's federal claims are DISMISSED WITH PREJUDICE;
2. Plaintiff's state law claims are DISMISSED WITHOUT PREJUDICE;
3. Plaintiff's cross-motion for partial summary judgement is hereby DENIED. [Page 351, ]
