ORDER DENYING PLAINTIFF'S APPLICATION TO ENJOIN DEFENDANT, DIRECTING DISTRIBUTION OF FUNDING AND ORDERING NEGOTIATION OVER THE DISTRIBUTION OF FUNDING
This matter having appeared before the Court upon Plaintiff's Motion to Compel Arbitration, the Court having reviewed the submissions of the parties, for the reasons set forth in an opinion issued by this Court, which findings of fact and conclusions of law are incorporated herein by reference, and for good cause appearing,
IT IS on this 3rd day of September, 2002,
1. Plaintiff's application to enjoin Defendant from distributing Quality Improvement funding is DENIED;
2. Defendant is DIRECTED to distribute the sum of $33,727.40 from the Quality Improvement funding received from the United States Department of Health and Human Services towards the salaries of its Head Start teachers;
3. Plaintiff and Defendant are ORDERED to negotiate the distribution of the sum stated above among the eligible Head Start teachers as per the terms of their collective bargaining agreements.
