ORDER

This matter came before the Court upon motion by defendant, Biao Zhang, to suppress statements he made to law enforcement agents on December 2, 1997 and December 5, 1997; and

Having considered the testimony and other evidence presented at the suppression hearing on Jaunary 6, 1999, and for the reasons stated in the Opinion Upon Suppression Motion filed today;

IT IS this day of February, 1999 hereby

ORDERED that defendant's suppression motion is granted in part and denied in part; it is denied with respect to defendant's statements on December 2, 1997 and December 5, 1997 prior to the end of the polygraph examination; it is granted with respect to oral and written statements given by defendant on December 5, 1997 conclusion of the polygraph examination, and thus the oral statement and written statement (Ex. G-4) given thereafter on December 5, 1997 shall be, and they hereby are, suppressed.
