After consideration of all contentions raised by appellant, it is

ADJUDGED and ORDERED that the order of the district court entered October 31, 1990, be and is hereby affirmed essentially for the reasons set forth by Judge Waldman in the aforesaid order. See Pearlstine v. United States, 649 F.2d 194, 198 (3d Cir. 1981) ("The taxation of costs, admittedly, is a matter within the discretion of the trial court.").

Costs taxed against appellant.
