The Merit Systems Protection Board, in DE315H8210070, dismissed petitioner's appeal from an initial decision affirming his termination while he was on probation because his appeal was three and one-half years late and he failed to respond in any manner to a request to show good cause for the delay. We affirm. The decision of the board was not arbitrary, capricious, an abuse of discretion, unsupported by substantial evidence, or otherwise not in accordance with law. See 5 USC 7703(c).

Affirmed.
