State v. Bartell

New Jersey Supreme Court

Decided: June 16, 1952.

STATE OF NEW JERSEY, PLAINTIFF-APPELLANT,
v.
GEORGE F. BARTELL, DEFENDANT-RESPONDENT

On appeal from a judgment of the Superior Court, Appellate Division, whose opinion is reported at 15 N.J. Super. 450. The justices being evenly divided on the question whether the judgment should be reversed, the judgment is affirmed solely because of such equal division, which renders any opinion by the court impossible.

For affirmance -- Justices Oliphant, Wachenfeld and Burling. For reversal -- Chief Justice Vanderbilt, and Justices Heher and Jacobs.
